Please read these terms and conditions of use carefully. By accessing or using this Network, you agree to be bound by the terms and conditions described herein and by all terms, policies and guidelines incorporated by reference. If you do not agree to all of these terms, do not use this Network.

This Wireless Network (“Network”) is owned and operated by the Schroeder Ambulatory Centre (“SAC”). These terms and conditions of use (“Network Terms”) apply to your use of the Network and do not alter in any way the terms and conditions of any other agreement between you and SAC, its subsidiaries or affiliates. By using this Network, you represent, warrant and covenant that you are of the legal age of majority and are lawfully able to accept these Network Terms. If you are under the age of 18, your parent or legal guardian accepts and agrees to the Network Terms on your behalf before you use the Network.

Breach of Network Terms

If you breach any provision of these Network Terms, damage the Network, modify or attempt to modify any software program used by this Network, or subvert or attempt to subvert any security devices that SAC has installed for this Network, SAC may terminate your right to use the Network. In addition, civil or criminal proceedings may be commenced against you.

You acknowledge and agree that these Network Terms are supported by reasonable and valuable consideration, including your use of the Network and receipt of data, materials and information available at or through the Network.

You agree that use of the SAC Network is a privilege. The Network may only be used for your own, non-commercial, personal or private educational purposes, provided that the Network is not modified and that copyright and other intellectual property notices are not interfered with, altered, obscured, added to or deleted. SAC reserves the sole and absolute right to revoke such Network privileges at any time without prior notice to you.

The Network is intended for Network visitors and users of the Network. You are specifically prohibited from using this Network or SAC content for any reason other than its intended purpose. You may not use the Network to:

  1. Intercept or monitor any communication of other users, or run a “server.”
  2. Provide a service accessible from outside the Network or by other users of the Network.

Parents Responsible for Supervising Minor Children’s Internet Use

SAC uses reasonable efforts to prevent access to criminal, obscene or hate material by providing a filtered wireless Network; however, filtering is not perfect. The supervision of minors while using the Network is the responsibility of their parents or guardians.

Public Use

Your access to the Network is in a public space, and you must not display materials which, in the opinion of any SAC staff, are unlawful, obscene, abusive or otherwise objectionable. You must immediately comply with directions from SAC staff to stop accessing or displaying such material. SAC assumes no responsibility for the security or privacy of any online transactions you conduct.

Security

SAC does not provide encryption or other security measures to protect your system or any information you send or receive over the internet. As with any internet connection, there is no inherent security. Use prudence when transmitting confidential or sensitive information.

Compliance with Laws

You represent, warrant and covenant that in accessing and using the Network you will comply with all applicable laws, rules, regulations and by-laws of Canada, including those relating to the internet, data, email and privacy.

Disclaimers

  1. General disclaimer: The Network and all operations may not be error-free or uninterrupted. It may not meet your requirements. Any content downloaded may not be free of viruses or destructive features. The Network is provided “as is” without warranties of any kind.
  2. IP infringement: Copying or distributing material found on the internet may infringe on the rights of others. SAC is not responsible for such infringements by you.
  3. Internet content: Information found on the internet may not be accurate, complete or current. SAC does not control internet information and assumes no responsibility for claims or damages.
  4. Internet connectivity: Wireless connections are prone to interference, signal loss and instability. Any wireless transmission is capable of interception, even via secure websites. Wi-Fi may also interfere with certain medical devices.

Exclusion of Liability and Release

Your access and use of this Network are at your own risk. To the extent permitted by law, SAC and its parties shall not be liable for any damages whatsoever arising directly or indirectly in connection with your use of the Network. You irrevocably release SAC Parties from all such liability and waive all rights to related claims.

Indemnification

You agree to defend, indemnify and hold harmless the SAC Parties against any claims, damages, loss, harm, costs, liabilities and expenses arising out of your access to and use of the Network, your conduct, your breach of these Network Terms, or your violation of any rights of others.

Applicable Law

This Network is controlled, operated and administered by SAC in Ontario, Canada. All matters relating to your access and use shall be exclusively governed by the laws of Ontario and the federal laws of Canada applicable therein. You submit to the non-exclusive jurisdiction of the courts in Ontario.

Severability

If any clause in these Network Terms is found to be unenforceable, the remaining clauses remain in full force and effect.

General

Any waiver of a provision of the Network Terms is effective only if in writing and signed by SAC. SAC’s failure to enforce any provision shall not be construed as a waiver of its rights.
